乔任梁、高以翔被AI“复活”，家人喊话下架！

　　近日，有人用AI技术“复活”了已故明星乔任梁，相关短视频在网上流传。视频中，“AI”生成的乔任梁向粉丝打着招呼，外形和声音与真人几乎无异。

　　而在视频评论区，有人打着温情的名义，趁机做起AI推广、收费服务……

　　However, in the video comments section, some individuals seized the opportunity to promote AI services under the guise of warmth and affection, offering paid services.

　　3月16日，乔任梁父亲告诉潇湘晨报记者，他已经看到网上传播开来的“儿子被复活”影像，不能接受，感到不舒适，希望对方尽快下架，“他们未征求我们同意，是我侄女刷到视频发给我的，这是在揭伤疤。”

　　17日，乔任梁父亲再度回应此事，他告诉红星新闻，视频“要是作为商业的、盈利的，这个我们是不认同的。”他还表示，粉丝出于纪念目的制作的相关视频，没有相关盈利的，他能够接受。

　　On March 16, Qiao Renliang's father told the Xiaoxiang Morning Herald that he felt very uncomfortable about the use of AI to recreate his deceased son and hoped the videos would be taken down soon.

　　除了乔任梁外，也有博主利用AI数字技术生成短视频，还原出李玟的声音和一颦一笑。

　　“嘿，你们好吗?我是Coco李玟……在我离开这个世界的那一刻起，我一直能感受到你们无尽的爱和支持……”视频中的“AI”李玟说。

　　其他被AI“复活”的还包括高以翔、张国荣、黄家驹等已故明星。视频中，他们几乎都是先向大家问好，再诉说对粉丝的思念等暖心话语。

　　Apart from Qiao Renliang, a blogger also utilized AI digital technology to generate short videos, replicating Coco Lee's voice and expressions.

　　Other celebrities "resurrected" by AI include Godfrey Gao, Leslie Cheung, and Wong Ka Kui. In the videos, they all greet the audience before expressing warm sentiments towards their fans.

　　据红星新闻报道，3月15日，高以翔生前经纪人转达高以翔家人的意见称，不希望高以翔肖像被他人任意使用，严厉地谴责并坚决抵制该行为，若不立即停止侵权行为，家人会采取法律行动。同时，其家人也呼吁粉丝朋友们保持理智，切勿轻易相信涉事博主的讯息。

　　Godfrey's former agent conveyed the wishes of his family to Red Star News on March 15, condemning the unauthorized use of his image for commercial promotion without consent. He emphasized that if the infringement was not halted immediately, the family would take legal action.

　　小编在一些短视频平台搜索，可以看到不少名为诸如“AI复活亲人”、“AI复活师”等相关账号。一些账号则在名称或简介中标出了“招学徒、招代理”等字样。在账号发布的视频下，可以看到有网友留言，求博主“复活”自己的偶像，也有网友询问如何收费。

　　A search on some short video platforms reveals numerous accounts with names like "AI Resurrecting Loved Ones" and "AI Resurrection Masters." Some accounts even explicitly mention "recruiting apprentices" or "seeking agents" in their names or descriptions. In the comments section of the videos posted by these accounts, some netizens ask the bloggers to "resurrect" their idols, while others inquire about fees.

　　其实，这已经不是第一次AI“复活”逝者引发公众关注。一些情况中，是逝者家人自愿，希望通过此举带给自己和家人一些情感抚慰。

　　In fact, this is not the first time that AI "resurrections" of the deceased have attracted public attention. In some cases, it is voluntary on the part of the deceased's family, aiming to find emotional comfort for themselves and their loved ones.

　　据中国日报报道，3月初，辽宁抚顺的孙先生用AI换脸技术“复活”了已经病逝的父亲，以父亲的口吻向91岁的奶奶报平安，以此安慰老人。

　　此事感动了许多网友，有人说：“看到了AI的正确打开方式”，“这才是科技发展的初心”。

He enabled his father to send greetings to his 91-year-old grandmother in his own voice, providing comfort to her. This act deeply moved many netizens, with some expressing sentiments such as, "This is the right way to use AI," and "This is the original intention of technological development."

　　不久前，一直无法走出女儿去世悲伤的音乐人包小柏，也用AI“复活”了女儿，并让“女儿”为妻子唱了生日歌，这带给了包小柏莫大的情感抚慰。

　　Additionally, not long ago, musician Pakho Chau, who had been struggling with the sadness of his daughter's death, also utilized AI to "resurrect" his daughter. He had "her" sing a birthday song to his wife, bringing him immense emotional comfort.

　　包小柏在接受潮新闻采访时表示，“其实，‘AI复活’是一个夸张化的称呼，我们没想过让现在的‘包容’完全变成真人一样。”包小柏说，“她”不可能也不需要做到那种境界。“在某种程度上，AI就是一种表达方式，是我们寄托思念的工具，”他说。

　　律师解读：逝者肖像和名誉仍受到法律保护

　　然而，从乔任梁、高以翔家人的喊话来看，相关博主在制作这些视频时，并没有征得他们同意。

　　据潇湘晨报报道，陕西恒达律师事务所律师赵良善表示，目前技术支持下的“复活”，本质上是利用深度合成技术生成虚拟人或者数字人，需要使用死者的人脸、声音等各种数据，配合自己的目的制作相应的内容。

　　但是据《民法典》第1019条规定，任何组织或者个人不得以丑化、污损，利用信息技术手段伪造等方式侵害他人的肖像权。未经同意不得制作、使用、公开他人肖像。

　　他告诉潇湘晨报记者，逝者的肖像、名誉权，仍受法律保护。《民法典》第994条明确规定，死者的姓名、肖像、名誉、隐私等受到侵害的，其配偶、子女、父母有权依法请求行为人承担民事责任;死者没有配偶、子女且父母已经死亡的，其他近亲属有权依法请求行为人承担民事责任。

　　科技一定是要向善的，一定是要为普通群众去服务的，针对数据隐私、AI诈骗、伦理争议等问题，一方面要不断完善相应的法律法规，另一方面，行业内也要足够自律，每一个从业者都应该守住底线。
